That’s right! We will handle your Uncontested Divorce for only a $595.00 flat fee (includes the filing fee) anywhere in the state of Virginia from one of our offices in Hampton Roads. To qualify you MUST meet the following criteria:
- Either you or your spouse MUST be a resident and domiciliary of Virginia.
- You and your spouse must be living separate and apart for at least one full year; OR have been living separate and apart for six months and have no children in common.
- You and your spouse have no custody, child support, or spousal support orders in place or child support, spousal support, or alimony issues to resolve.
- Your spouse is willing and able to sign off on the divorce papers (acceptance of service waiver, Simple PSA and Final Decree) in front of a notary public and hand deliver or mail them back to our office.
- You and your spouse have no property to divide (houses, pensions, retirements, automobiles, debt, etc.) and neither of you are seeking child support or spousal support.
What is an Uncontested Divorce?
Very simply, an uncontested divorce, particularly the one that we are offering to handle for $595.00, is one where there are NO issues to address in the divorce AND the defendant is willing and able to sign off on the divorce papers that we send to him or her.
A FREE Simple Property Separation Agreement (PSA) is included in the Uncontested Divorce service if you (1) have no children, (2) have lived separate and apart for less than one year, and (3) have no support or equitable distribution issues to address.
We can still help you get a divorce even if you have child support, spousal support, or property division issues to address. So long as your spouse is willing to sign off on a Property Settlement Agreement (PSA), we can draft the PSA and send it to your spouse for signature. If he or she signs it, then we can just follow the same steps previously outlined. A PSA that addresses these issues is not considered a Simple PSA and is not free. During your phone consultation, an attorney will quote you a price for a more complex PSA that deals with custody, support, or division of assets.
A PSA can address nearly any issue that comes up in a divorce, including child custody, child support, visitation, spousal support, pensions, retirements, real property, insurance, personal property, future tax refunds, and more. Before hiring us to draft a PSA you need to speak to your spouse to make sure they are willing to sign it. If your spouse refuses to sign the PSA then we would NOT be able to proceed with the $595.00 Uncontested Divorce. However, if your spouse does sign off on the PSA, then it will be filed with the court and be incorporated into your Uncontested Divorce. Once incorporated into your Final Decree of divorce, the PSA will have the same force and effect as a court order.
Your divorce may not be filed in the city or town in which you live. The Virginia Code allows for a divorce to be filed in any court in the Commonwealth so long as at least one party resides in and is domiciled somewhere in Virginia.
If you meet the foregoing criteria, then follow the steps below to obtaining a Simple Virginia Uncontested Divorce:
Step One: Before you call our office or fill out our intake form below, CALL your spouse to verify that he or she is willing to sign the divorce papers. Make sure that you get his or her correct mailing address and phone number to give to us. If your spouse is not willing to sign divorce papers then this service is NOT for you.
Step Two: Completely and accurately fill out our online intake form below and attach a copy of your Marriage License and Photo ID. The marriage license and photo ID are required to protect YOU from identity theft and fraud and confirms that it is really you seeking the divorce.
Step Three: We will schedule you a FREE phone consultation or, if local, an appointment in one of our Hampton Roads offices with one of our lawyers. If you qualify for a simple no-fault Uncontested Divorce, then the lawyer will then email you a retainer agreement.
Step Four: Sign your retainer and email it back to the Lawyer with any other documents necessary to complete your case. Then pay the $595.00 fee over the phone.
Step Five: We prepare the divorce documents and send them to your spouse via First-Class mail or they can be picked up at our office. An affidavit must also be signed before a Notary Public and returned.
Step Six: Your spouse must sign them before a Notary public and return them to us with a copy of some form of photo identification.
Step Seven: The divorce documents are then filed with a Circuit Court in Virginia once received back from your spouse. From here, please allow six weeks to process.
Step Eight: Once we receive the entered Final Decree of Divorce back from the Circuit Court, then we will mail you a copy for your records.
